Felony Drug Charges Reduced in Clinton County

On Behalf of | Sep 12, 2019 | Case Results, Drug Charge, Firm News

Recently, an individual in Clinton County was charged with possession of methamphetamines and possession of analogues. If found guilty of both offenses, the man could face up to 10 years in prison and $17,000 in fines. Wanting to avoid convictions on both felony charges, he reached out to DeBruin Law PLLC for help.

Lansing drug crimes attorney Tiffany DeBruin immediately got to work on the client’s case. While the issue was pending, however, the client received a job opportunity in Tennessee, so attorney DeBruin petitioned the court to allow him to move. Permission to do so was granted.

As the case progressed, attorney DeBruin uncovered problems with the traffic stop and the way the client came to the attention of the officer in the first place. She spoke with the prosecutor and discussed filing a motion to challenge the stop and suppress the evidence, pointing out the flaws in the case. Following this, her client accepted a plea offer of two misdemeanor offenses.

At the time of sentencing, both the client and attorney DeBruin were concerned about incarceration, as the client had two prior drug felonies and one prior drug misdemeanor. As such, attorney DeBruin counseled the client on what to do between the time of plea and sentencing. They found a reputable agency for him to complete a substance abuse assessment in TN, connected him with a counselor, and had him take weekly drug screens. As such, at the time of sentencing, he was only ordered to complete one year of probation reporting to the Clinton County agent remotely from TN.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
